Situations That Don’t Require a Permit:
The following types of construction do not require a building permit (pretty much everything else does!):
- One-story detached accessory structures, provided that the projected roof area is 120 sq ft. or less and has no electrical or plumbing
- Fences 6ft in height or less
- Cases, counters, or partitions 69 inches high or less
- Retaining walls of 3ft or less with no surcharge
- Platforms, decks, walks and driveways that are 30 inches or less above grade
- Painting
- Patio covers 300 sq ft. or less under a projected roof and 12ft or less above grade and does not encroach into any yard.
- Repair that includes painting and decorating, installing floor covering, cabinet work, and outside paving.
Common Reasons That Building Owners Avoid Addressing Their Un-Permitted Issues:
- They purchased the property with its existing condition(s) and believe it to be “grandfathered” into the current building code(s)
- The property was built 40+ years ago by someone in the construction field
- They believe since they own the property, it gives them free reign to do what they choose without adhering to current building codes and standards
- Didn’t know it was unpermitted
- Didn’t want to pay permit fees
- Didn’t want their property taxes to rise for additional living spaces
- Didn’t know the proper steps to obtaining a building permit for a legal structure
- Some just don’t care
- The City didn’t catch them or there were no complaints so it must be ok
- Wanted to maximize the use of the property
- The contractor/draftsman/architect didn’t advise the owner to get a permit for their construction work
- All work performed was interior
- Need to continue to collect the extra income from a rental unit
